Case 6 — Unmarried, With Both Parents Deceased

The deceased never married and both parents had died. The estate passes to the full siblings.

UnmarriedSiblingsAsabah

The deceased died on 11 December 2022 in a road accident at the age of 38, and had never married.

The Facts

  • Both parents had died sometime in the 1990s.
  • There were three full siblings including the deceased — two brothers and one sister: Intan, the deceased, and Ali.
  • Maternal half–siblings — none.

The Faraid Distribution

Once the investigation into the heirs was complete, the faraid distribution was as follows:

Note. Because the deceased was unmarried and both parents had died, the estate falls to the full siblings as asabah, the brother taking twice the sister’s share.

I hope this helps.

Is your case different? A slightly different set of heirs can change the whole distribution. Send me the facts of your case on WhatsApp and I will help you check.
