Case 7 — Full Siblings Alongside Maternal Half–Siblings

Two categories of sibling inherit at the same time. How are their shares told apart?

MaternalFullFaraid

The deceased, Farid, died on 11 December 2022 in a road accident at the age of 38, having never married.

The Facts

  • His father, Daud, died sometime in the 1990s.
  • His mother, Lina, died around 2010. Before that she had married Zulkepli and had two children: Zaki (son) and Amirah (daughter). Zulkepli died in 2007.
  • There were three full siblings including the deceased — two brothers and one sister: Ali, Intan and the deceased (Farid).
  • There were two maternal half–siblings: Zaki (brother) and Amirah (sister).

The Faraid Distribution

After the heirs were investigated, the faraid distribution was as follows:

An important distinction. Maternal half–siblings (Zaki and Amirah) take equal shares regardless of sex — 3/18 each. Full siblings, by contrast, inherit as asabah, where a brother takes twice a sister’s share.

I hope this helps.

Is your case different? A slightly different set of heirs can change the whole distribution. Send me the facts of your case on WhatsApp and I will help you check.
